Question: I recently quit my job as a restaurant manager and took a warehouse job making about $10,000 less per year.Several reasons why I quit: My hours were changing from 7am-5pm to either 9:30am-8pm or 3:30pm to 12:30am and with a wife who works all dayshifts and 2 kids I wouldn't be able to see very much, my last reveiw was poor and I was probably gonna get fired with-in the next few months because of my general managers and my difference of opinion on how things should be done. Due to the difference In money I'm asking for a child support reduction from $630 to $430 per month. My ex Is fighting mr because I made a comment several years ago when we were still together I would take a lower paying job just to pay less child support. I made the comment during an argument and In anger and would certainly not take a job making $10,000 less per year just so I could give her $2400 less per year In support. Any chance I can win this In court and get my support lowered? Answer: Talk to and retain a lawyer. Each state has its own laws so it would be hard to say without knowing the state involved. I can tell you that missouri law bases the child support off a Form 14 that will report the incomes of both houses and takes into consideration additional expenses, other children you provide support for etc. The basic rule of thumb is that you must have enough of a change to warrent a 20% difference in support amount before the court will do anything, and then it will not be allowed to be evaluated again for 3 years. Again..this is all missouri law, but some other states have very similar methods, I believe. Although the court may entertain heated comments showing possible malicious motivation on your part, I think you have shown other legitimate reasons for the job change. It is still most important to have a lawyer represent you in this case. I don't know what your making but that sounds like a pretty high support amount for one child (if it is one child) considering that you are the primary support for two other children, based on what restaurants and warehouse jobs pay. But its hard to say again without knowing yours and your ex wifes incomes...you could put those values into a form 14 calculator to see what sort of number it spits out.
